Mitchell Levitin represents high-net-worth and high-conflict individuals on the full spectrum of matrimonial law issues before New York State trial and appellate courts. He regularly advises on complex matters involving the evaluation and distribution of assets, determination of separate property claims, spousal and child support, custody and parental access, and the validity of agreements.
In addition to litigating and trying disputes with many of the elite practitioners of matrimonial law in all of the downstate counties, Mitchell negotiates pre-nuptial, post-nuptial, and separation agreements. He also has significant experience representing clients with complex separate property issues, international and interstate custody and relocation issues, and has drafted Beth Din (religious) pre-nuptial agreements.
Mitchell is known for his ability to draft complex yet accessible documents, his financial analysis skills, and his wide scope of knowledge of other legal areas including bankruptcy, guardianship law, and real property law. His appellate brief-drafting has resulted in several “Decisions of Interest,” some featured on the front page of the New York Law Journal, including Masella v. Masella, 67 A.D.3d 749 (Second Dept. 2009) (tracing of separate property assets; disability income as separate property); Brody v. Brody, 88 A.D.3d 757 (Second Dept. 2011) (temporary support & counsel fees); Mathie v. Mathie, 65 A.D.3d 527 (Second Dept. 2009) (relocation of child); Greenspan v. Greenspan, 56 A.D.3d 524 (Second Dept. 2008) (payment of private school tuition); and Wattenberg v. Wattenberg, 289 A.D.2d 73 (N.Y. App. Div. 2001) (enforcement of nuptial agreement).
Before joining KSTM, Mitchell practiced in the matrimonial group at Phillips Nizer LLP alongside Richard Adago. He has previously appeared on national television as a panelist on family law issues.
